PUBLIC NOTICE TO ALL PERSONS WHO SOLD, ACQUIRED OR DEVELOPED BAKWERI ANCESTRAL LANDS WITHOUT DUE PROCESS

By Dr. David Makongo ·

We have adopted a respectful, transparent and accountable legal process to identify, recover and protect Bakweri ancestral lands that may have been unlawfully sold, transferred, titled, occupied or developed.

This notice is directed to all concerned persons and institutions, including:

  1. Government officials involved in land administration;
  2. Former and current Divisional Officers;
  3. Former and current Governors;
  4. Former and current Ministers;
  5. Fako elites at home and abroad; and
  6. Buyers, builders, developers, companies and associations at home and abroad.

OUR LEGAL APPROACH

First: Investigation and verification

Every case will be properly documented and investigated. Relevant administrative records, land titles, survey plans, sale agreements and other supporting documents will be examined.

Second: Formal notice and the right to respond

Before legal action is taken, every concerned person will receive written notice identifying the land, presenting the relevant facts and allegations, and providing a reasonable opportunity to respond and submit evidence.

Third: Voluntary restitution and protection of innocent purchasers

Anyone who acknowledges that the land was unlawfully acquired will be invited to surrender it voluntarily. Where a person proves that they are a bona fide purchaser for value without notice of any defect, we will support lawful efforts to recover their money or pursue the person who misled or wrongfully sold the land.

Fourth: Legal action where cooperation fails

Where evidence establishes theft, fraud, forgery, unlawful sale, illegal occupation or improper acquisition—and voluntary restitution is refused—we will pursue all available remedies before the competent courts and administrative authorities.

We will seek the cancellation of unlawfully obtained titles, restitution of the land, damages where appropriate and accountability for every person who participated in the transaction. Any buildings or fixtures affected will be handled strictly according to law and pursuant to the decisions of the competent authorities or courts.

THE FUTURE OF RECOVERED LANDS

Every parcel lawfully recovered will be placed within a Bakweri Ancestral Land Portfolio and protected as community land. No recovered land will become the private property of any individual leading this process.

Working with the Government, traditional authorities, affected communities and other legitimate stakeholders, we will establish transparent procedures for the responsible allocation and development of appropriate land by persons and institutions possessing the necessary financial and technical capacity.

The objective is not revenge, intimidation or disorder. It is lawful restitution, community protection, responsible development and justice.

Anyone holding Bakweri ancestral land should therefore verify the legality of its origin and preserve every document connected to its acquisition. Cooperation will be respected; concealment, fraud and obstruction will be challenged through the full force of the law.

We will recover our ancestral lands peacefully, transparently and lawfully—and every recovered parcel will be protected for the benefit of the community and future generations.
